Terms & Conditions

These Terms & Conditions (the “Terms”) are an agreement between Enegotz Technologies Pty Ltd (“unboxx.app”, “we”, “us”) and you, the merchant or visitor using the unboxx.app Shopify application (the “App”) or https://unboxx.app(the “Site”). By installing the App or using the Site, you agree to these Terms.

1. The service

unboxx.app is a creator gifting platform for Shopify: it provides creator discovery, branded gifting links, automated draft orders, a creator CRM, content tracking, and sales attribution. Features vary by plan as described on our pricing page.

2. Eligibility and accounts

You must have an active Shopify store and the authority to bind the business you represent. You are responsible for activity under your account and for keeping your Shopify credentials secure.

3. Plans, billing, and changes

• Paid plans are billed monthly through Shopify’s billing system at the prices shown at purchase, plus applicable taxes.
• You can upgrade, downgrade, or cancel at any time; changes take effect per Shopify’s billing cycle rules. Uninstalling the App cancels future charges.
• Plan limits (links, orders, credits, tracked content, and CRM capacity) are enforced per plan. We may adjust plan features or pricing with reasonable prior notice; changes do not apply retroactively to a paid billing period.
• Fees are non-refundable except where required by law or Shopify policy.

4. Your responsibilities

• Run gifting campaigns lawfully, including consumer-protection and advertising-disclosure rules that apply to you and your creators (such as FTC endorsement guidelines).
• Provide accurate product, shipping, and campaign information to creators.
• Obtain any consents required to contact creators and to use their submitted information.
• Honor the usage-rights terms you present to creators through your gifting links.

5. Creator content and usage rights

Usage rights to creator content are granted by creators to you, the merchant, under the terms you configure in your gifting links. unboxx.app facilitates the capture and storage of those grants but is not a party to them. You are responsible for using creator content only within the scope of the rights granted.

6. Acceptable use

• No unlawful, deceptive, or infringing activity, including spam or unsolicited bulk outreach in violation of applicable law.
• No attempts to scrape, resell, or extract our creator index outside the App.
• No reverse engineering, interference with the service, or circumvention of plan limits or security measures.

We may suspend or terminate access for breach of these Terms.

7. Third-party services

The App and the Site interoperate with third-party services such as Shopify, Klaviyo, and Calendly. Your use of those services is governed by their own terms, and we are not responsible for them.

8. Intellectual property

We own the App, the Site, and all related intellectual property. We grant you a limited, non-exclusive, non-transferable license to use the App for your store while these Terms are in effect. If you send us feedback, we may use it without restriction.

9. Data

Our collection and use of personal information is described in the Privacy Policy. For creator data collected through your gifting links, you are the controller and we process it on your behalf to provide the service.

10. Disclaimers

The service is provided “as is” without warranties of any kind. Creator statistics, content detection, and sales attribution are estimates based on available data and may be incomplete. We do not guarantee campaign outcomes, creator responses, or revenue.

11. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or revenue. Our total liability for any claim is limited to the fees you paid us in the twelve months before the event giving rise to the claim.

12. Indemnification

You will indemnify us against claims arising from your campaigns, your use of creator content beyond granted rights, or your breach of these Terms or applicable law.

13. Termination

You may stop using the service at any time by uninstalling the App. We may suspend or terminate the service for breach, unlawful use, or risk to the platform. Sections that by their nature should survive termination (including 8, 10, 11, and 12) survive.

14. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and revise the “Last updated” date; material changes will be notified to merchants. Continued use after changes take effect constitutes acceptance.

15. Governing law

These Terms are governed by the laws of Australia, without regard to conflict-of-law rules, and disputes are subject to the exclusive jurisdiction of the courts of Australia.
